Terms and Conditions with Customer Information
Scope
1. Scope of Application
1.1 These Terms and Conditions apply exclusively to the business relationship between Melikov & Dettler GbR, Schonensche Straße 5, 10439 Berlin, Germany (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”) in the version valid at the time of the order.

1.3 A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 German Civil Code – BGB).
1.4 Deviating terms and conditions of the Customer shall not be recognized unless the Seller expressly agrees to their validity.
2. Product Offers and Descriptions
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
Product descriptions in catalogs and on the Seller’s website do not constitute a guarantee or warranty.
All offers are valid “while stocks last”, unless otherwise indicated for specific products. Errors and omissions are excepted.
3. Ordering Process and Conclusion of Contract
3.1 The Customer may select products from the Seller’s assortment without obligation and collect them in a virtual shopping cart using the button “Add to Cart.” Within the shopping cart, product selections can be modified or removed. The Customer can then proceed to checkout using the “Checkout” button.
3.2 By clicking the button “Place order with obligation to pay”, the Customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the Customer may review and change the information at any time using the browser’s back function or cancel the order entirely. Required fields are marked with an asterisk (*).
3.3 The Seller will then send the Customer an automatic order confirmation by email listing the details of the order (order confirmation). This confirmation only documents that the order has been received and does not constitute acceptance of the offer.
The purchase contract is concluded only when the Seller dispatches the ordered goods within 2 days, delivers the goods, or confirms dispatch by email, order confirmation, or invoice.
3.4 If advance payment is offered, the contract is concluded when the Seller provides the bank details and requests payment.
If payment has not been received within 10 calendar days after sending the order confirmation despite a reminder, the Seller may withdraw from the contract and the order will be cancelled without further obligations.
Items reserved with advance payment are therefore held for a maximum of 10 calendar days.
4. Prices, Shipping Costs and Taxes / Duties
4.1 All prices stated on the Seller’s website include the applicable statutory value-added tax (VAT).
For deliveries to non-EU countries, additional customs duties, taxes, or fees may apply.
4.2 In addition to the product prices, shipping costs are charged for delivery. These are clearly communicated during the ordering process and on a separate information page.
5. Delivery and Product Availability
5.1 If advance payment has been agreed, delivery will take place after receipt of payment.
5.2 If delivery fails after three attempts due to the Customer’s fault, the Seller may withdraw from the contract. Any payments already made will be refunded immediately.
5.3 If the ordered product is not available because the Seller is not supplied by its supplier without fault of its own, the Seller may withdraw from the contract. The Customer will be informed immediately and may be offered a comparable product.
If no comparable product is available or the Customer does not wish to receive it, payments already made will be refunded immediately.
5.4 Information about delivery times and delivery restrictions (for example restrictions for certain countries) can be found on a separate information page or in the respective product description.
6. Payment Terms
6.1 The Customer may choose from the available payment methods before completing the order process. Available payment methods are listed on a separate information page.
6.2 If payment by invoice is available, payment must be made within 14 days after receipt of the goods and invoice.
For all other payment methods, payment must be made in advance without deduction.
6.3 If third-party payment service providers are used (e.g. PayPal, Klarna, Stripe), their terms and conditions apply.
6.4 If a payment deadline is determined by calendar date, the Customer will already be in default by missing the payment deadline.
6.5 The Customer may only offset claims if their counterclaims have been legally established or acknowledged by the Seller. A right of retention may only be exercised if the claims arise from the same contractual relationship.
7. Retention of Title
The delivered goods remain the property of the Seller until full payment has been made.
8. Warranty and Guarantees
8.1 The statutory warranty provisions apply.
8.2 A guarantee for goods delivered by the Seller only exists if this has been expressly stated within the statutory warranty period. Customers will be informed about warranty conditions before placing an order.
9. Liability
9.1 The following exclusions and limitations of liability apply to claims for damages against the Seller, without prejudice to other statutory requirements.
9.2 The Seller shall be liable without limitation if the cause of damage is based on intent or gross negligence.
9.3 In the case of a slightly negligent breach of essential contractual obligations whose fulfillment is necessary for the proper execution of the contract and on whose compliance the Customer regularly relies, liability shall be limited to the foreseeable and typical contractual damage.
9.4 The above limitations of liability do not apply in cases of injury to life, body, or health, in cases of a defect after assuming a guarantee for the condition of the product, or in cases of fraudulently concealed defects. Liability under the German Product Liability Act remains unaffected.
9.5 Where the liability of the Seller is excluded or limited, this also applies to the personal liability of employees, representatives, and agents.
10. Storage of the Contract Text
10.1 The Customer may print the contract text before submitting the order by using the print function of their browser in the final step of the order process.
10.2 The Seller will also send the Customer an order confirmation with all order details to the email address provided.
Together with the order confirmation or at the latest upon delivery, the Customer will receive a copy of these Terms and Conditions including the withdrawal policy and information about shipping costs as well as delivery and payment conditions.
If the Customer has created a user account, orders can be viewed in the profile area. The contract text will be stored by the Seller but will not be accessible online.
11. Final Provisions
11.1 If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction and performance shall be the registered office of the Seller.
11.2 The contract language is German.
11.3 The Seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
